Terms of Use — Wix Apps

The short version

Install an app, use the free plan for as long as you like, and pay Wix for a paid plan if it earns it. You configure what the app does on your store and you are responsible for those choices. The apps are provided as-is, and our liability is limited to what you paid for the app in the last twelve months. Support is by email, answered within two business days.

1. Who these terms are with

The Wix apps listed in section 2 are published by Builds By Luke (“we”, “us”). By installing or using any of them you agree to these terms. You also agree to Wix’s own Terms of Use and the Wix App Market terms, which govern your Wix account, the App Market and billing; where those and these terms overlap, Wix’s terms govern your relationship with Wix and these terms govern your relationship with us.

2. The apps

Site Search & Product Search — Instant search for products, pages and posts that is never out of date — results come from the live catalog, not a stale copy.
Bundles & Volume Discounts — Buy-more-save-more pricing and bundle deals, applied automatically at checkout — no coupon codes, no checkout plugin.
Product Add-ons & Extras — Gift wrapping, engraving text and paid extras on the product page you already have, charged at checkout as named fees.
Comments & Moderation — Comment threads on any page, with a spam filter that explains itself and an approval queue you actually control.
FAQ Sections & Search — A separate FAQ for every page, with search that stays inside the section it is on and nothing ever added to a page for you.

Each app’s page describes what it does, which Wix permissions it asks for and why, what it stores and where, and which features belong to which plan. Those pages are part of these terms.

3. Plans, trials and billing

Every app has a free plan that does not expire. Paid plans unlock the features listed on the app’s App Market listing and its page here.
Paid plans are sold and billed by Wix through the Wix App Market, per site, monthly or yearly. Prices are shown in the App Market at the time you subscribe.
Paid plans start with a 14-day free trial of Pro. Renewals, cancellations and refunds are handled by Wix under the Wix App Market policies; cancel from your Wix account at any time, and the plan runs to the end of the period already paid for.
We may change prices for new subscriptions by updating the App Market listing. A change applies to an existing subscription only as Wix’s App Market rules allow, with notice.

4. Your responsibilities

As the owner of the site the app is installed on, you are responsible for:

What you configure. The offers, extras, prices, searchable content and settings are yours. Check totals with a test order before announcing an offer or an extra, and pause or delete anything you no longer want applied.
Fulfilling what you sell. An extra a shopper paid for, or a discount a shopper received, is between you and your shopper; the app only records and applies it.
Your content and your data. The products, pages and posts the apps read are yours, and so is the data the apps store inside your site, including anything your visitors and shoppers submit through them. You are responsible for your own privacy notices and for complying with the laws that apply to your store.
Comments posted on your site. If you run Comments & Moderation, the comments your visitors post are published on your site, by you. You decide whether they appear immediately or wait for approval, and you are responsible for what stays up, including anything unlawful, defamatory or infringing. The spam filter is an aid to that job, not a substitute for it: it is best effort, it will sometimes catch a genuine comment and sometimes miss a junk one, and every decision it makes is reversible by you.
Compliance with Wix. You must keep to Wix’s terms and policies while using the apps.

5. Acceptable use

You agree not to:

use an app for anything unlawful, or in a way that breaches someone else’s rights;
interfere with an app, with Wix, or with any other site’s use of an app, including by probing or overloading them;
copy, modify, reverse engineer or resell an app, except to the extent the law expressly allows;
use the search, discount, extras or comment features to expose, publish or process content you are not permitted to publish.

6. Availability and changes

The apps run on Wix’s infrastructure and depend on Wix services, so they may be interrupted by Wix maintenance or outages that are outside our control. We aim for continuous availability but do not guarantee it. We may update an app at any time to fix problems, improve it or keep it working with Wix; material changes to a paid feature will be announced in the app’s dashboard. If we ever retire an app, we will give at least 30 days’ notice through the App Market listing or the dashboard.

7. Support

Support is by email at [email protected], answered within two business days. Support covers the app; questions about your Wix account, billing or the Wix platform itself belong to Wix support.

8. Ownership

The apps, including their code, design and documentation, belong to Builds By Luke. Installing an app gives you a non-exclusive, non-transferable licence to use it on the site it is installed on, for as long as it stays installed and you keep to these terms. Your content and your store’s data remain yours.

9. Disclaimer

The apps are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that an app will be error-free, uninterrupted, or produce any particular commercial result: a discount, a bundle, an extra, a search feature or a spam filter is a tool, and how it performs for your site depends on how you use it. In particular, no spam filter catches everything, and none is free of false positives.

10. Limitation of liability

To the fullest extent permitted by law, our total liability to you for anything arising out of or connected with an app is limited to the fees you paid for that app in the twelve months before the claim arose, and we are not liable for indirect, incidental, consequential or special losses, including lost revenue or profits, lost data or business interruption. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law.

11. Termination

Uninstalling an app ends this agreement for that site. We may suspend or end your use of an app if you breach these terms or Wix’s policies. On uninstall the app’s collections are removed from your site; for Bundles & Volume Discounts, the automatic discount rules it created remain visible under Marketing → Discounts until you delete them, so pause or delete offers first if you do not want them to keep applying.

12. Governing law

These terms are governed by the laws of Ontario, Canada, and the federal laws of Canada that apply there, without regard to conflict-of-law rules. Any dispute that cannot be resolved between us will be brought in the courts of Ontario, Canada, unless the law where you live gives you the right to bring it elsewhere.

13. Changes to these terms

If these terms change in any material way, the revised version will be posted on this page with a new effective date at the top. Continuing to use an app after that date means you accept the revised terms.
