Terms of Use for the GHL apps

The short version
Install an app, try it free for the trial period, and pay through the marketplace if it earns it. You build the workflow and you decide what data flows into each step, so those choices are yours. Where an app connects to another service, you bring your own credential and your relationship with that service is with them. The apps are provided as-is, and our liability is limited to what you paid for the app in the last twelve months. Support is by email, answered within one business day.
1. Who these terms are with
These terms are between you and Builds By Luke ("we", "us"), based in Canada. They govern the workflow-automation apps listed below. By installing or using one of them you agree to these terms. If you do not agree, do not install them.

These terms cover the apps only. The buildsbyluke.com website is covered by the site terms, which are separate and unchanged. Your use of the automation platform itself is governed by your agreement with that platform, not by us.
2. Licence
While your subscription is active we grant you a non-exclusive, non-transferable right to use the app inside your own account, for your own business or for accounts you manage on behalf of clients. You may not resell, sublicense, rent or redistribute an app on its own, decompile it, or attempt to extract its source in order to reproduce it.
3. Plans, trials and billing
- All billing is handled by the marketplace. We never take payment directly and never see your card details.
- Every paid plan begins with a free trial as stated on the app’s page. If you cancel before it ends you are not charged.
- Subscriptions renew on the interval you chose until cancelled. Cancel through the marketplace; access continues until the end of the period you have paid for.
- There is no per-run charge from us. A subscription covers unlimited executions of that app’s steps. The marketplace may display its own per-execution charge on premium steps; that is set by the platform, not by us, and we do not control it.
- Refunds follow the marketplace’s policy. If something is genuinely broken, write to us first — we would rather fix it.
- Prices may change for future billing periods. A change never applies to a period you have already paid for, and existing subscribers are told before it takes effect.
4. Your responsibilities
- You decide which data flows into each step and what the workflow does with the result. You are responsible to your own contacts for that, including having a lawful basis to process their information and honouring their marketing preferences.
- You are responsible for keeping any credential you paste into a step secure, and for revoking it if it is exposed. Store it in a Custom Value rather than repeating it, so it can be rotated in one place.
- Do not use an app to send unsolicited messages, to harvest data you have no right to, or for anything unlawful.
- Test a workflow before you point it at real contacts. A step that does exactly what you configured is not a defect.
5. Third-party services
Some apps connect to a service you already use, with a credential you create:
- Agora Store Tools for Shopify connects to Shopify.
- Your relationship with that service — the account, the fees, the terms, the privacy policy — is between you and them. We are not a party to it.
- We do not control that service’s API and cannot guarantee its availability, behaviour or continued existence. If they change or withdraw something, an app that depends on it may stop working until it is updated.
- We are independent of every such service and are not affiliated with, endorsed by, or sponsored by any of them. Their names are used only to describe what an app is compatible with, and all trademarks belong to their owners.
- Any charges that service levies on your account for API usage are yours, not ours.
6. What we promise, and what we do not
We promise the apps do what their pages say they do, that we will not add data collection without saying so first, and that a first response to a support email arrives within one business day.
Beyond that, the apps are provided as-is and as-available, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant uninterrupted or error-free operation, because an app runs inside a platform we do not control and, for connectors, depends on a service we do not control either.
7. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost revenue, lost business or lost or corrupted data, however caused.
Our total aggregate liability arising out of or relating to an app is limited to the amount you actually paid for that app in the twelve months before the claim arose.
Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud, or for death or personal injury caused by negligence.
8. Availability and changes
We may update an app to fix defects, follow a platform change, or add capability. We may discontinue an app; if we do, we will give reasonable notice through the marketplace and you will not be charged for a period you cannot use.
An app’s page may describe a build that is not yet released. Those descriptions are statements of intent, not commitments, and nothing on this site is an offer to supply something that is not yet available.
9. Ending it
You can uninstall an app or cancel its subscription at any time through the marketplace. We may suspend or end access if these terms are breached in a way that is not put right after we have asked. On termination the licence in section 2 ends; sections 6, 7 and 10 survive.
10. Governing law
These terms are governed by the laws of Ontario, Canada, and the courts of Ontario, Canada have exclusive jurisdiction, without limiting any mandatory consumer protection you have where you live.
